1. The agreement
These terms are a contract between you and Adam Richard Turner (“I”, “me”, “my”), an individual sole trader based in the United Kingdom, trading as Sleep Coach. They apply when you download, install, create an account for, or use the Sleep Coach mobile app (the “App”), and when you use cbtinsomnia.app (the “Site”).
By creating an account, ticking the agreement box in the App, or continuing to use the App you confirm that you have read and agree to these terms. If you do not agree, do not use the App.
2. Wellness education, not medical care
Sleep Coach is a general wellness and educational product. It is not a medical device, is not therapy, and does not diagnose, treat, cure, prevent, mitigate or manage insomnia or any other disease, disorder or condition. It is not an NHS service and is not regulated as healthcare. Adam Richard Turner is not a doctor or a registered healthcare professional.
The Wellness Disclaimer forms part of these terms. You must not rely on the App instead of advice from your GP or another qualified clinician, and you must not start, stop or change any medication because of anything in the App.
3. Eligibility
You must be 18 or older and able to enter into a contract under the law of England and Wales. The App is not directed at children. Do not create an account for anyone else.
The App is designed for people who want general sleep-habit education. Please do not use it, or speak with a clinician first, if you are pregnant, have epilepsy or bipolar disorder, have a diagnosed or suspected sleep disorder such as sleep apnoea or narcolepsy, work shifts or drive or operate machinery for a living, or have been advised by a clinician to avoid sleep restriction.
4. Your licence to use the App
I grant you a personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to download, install and use the App on any Apple-branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, for your own personal, non-commercial use.
You may not copy, modify, distribute, sell, rent, lease, reverse-engineer, decompile or attempt to extract the source code of the App, except where the law expressly allows it, and you may not remove any proprietary notices.
5. Your account
You can sign up with email, Sign in with Apple, or Google. You are responsible for the information you provide and for keeping your sign-in details secure. Tell me promptly at hello@adamrichardturner.dev if you think someone else has used your account.
You can delete your account at any time from More → Delete account in the App. See Delete your account for what happens to your data.
6. Acceptable use
Use the App lawfully and only for your own sleep-habit education. You must not:
- attempt to gain unauthorised access to the App, its servers or other users’ data;
- interfere with, overload or disrupt the service, or use bots or scrapers;
- use Chat to generate content unrelated to sleep habits, or to try to make the AI produce unlawful, harmful, sexual, hateful or self-harm content;
- upload content that is unlawful or that you do not have the right to share, including other people’s health information;
- use the App to provide a service to others, or for any clinical, diagnostic or commercial purpose.
I may suspend or end your access if you break these terms or if your use creates a safety, security or legal risk.
7. Apple Health, Google Health and notifications
Connecting Apple Health is optional. If you allow it, the App reads Sleep samples to fill your diary and may write your planned sleep window to Health. Connecting Google Health (Fitbit or Pixel Watch) is optional and read-only for sleep data. You control these permissions in iOS Settings, your Google Account, or More → Sleep data. See the Health Data notice.
Reminders are optional local notifications scheduled on your device. You can pause them in the App or turn them off in iOS Settings.
Data from trackers can be incomplete or inaccurate. The App’s charts and verdicts are only as good as the data they receive.
8. AI-generated content
Chat and Sleep review use third-party generative AI. Replies are produced automatically, are not reviewed by a person or a clinician before you see them, and may be inaccurate, incomplete or inappropriate for you. They are educational suggestions about habits, not personalised medical advice. You decide what, if anything, to act on.
As between you and me, you own the prompts you type, and you may use AI replies for your personal use. You must not represent AI output as advice from a clinician. Full details are in the AI Transparency notice.
9. Your content and my intellectual property
You keep ownership of the diary entries, notes and worksheet answers you create. You give me a limited, non-exclusive licence to host, store and process that content only so the App can work for you, as described in the Privacy Policy.
I own, or use under licence, the App, the Site, the Sleep Coach name and moon logo, the educational articles, worksheets and all other content I provide. Nothing in these terms transfers those rights to you.
10. Price and purchases
The App is currently free to download and use. If I introduce paid features, they will be clearly described and priced before you buy, and purchases will be made through Apple’s In-App Purchase system under Apple’s terms. Apple handles billing, renewals and refund requests for those purchases.
11. Availability and changes
I aim to keep the App available and working but I do not promise that it will be uninterrupted, error-free or compatible with every device. I may change, suspend or withdraw features, and I may withdraw the App, giving reasonable notice where I can.
12. Liability
I provide the App with reasonable care and skill. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited under the law of England and Wales.
Subject to that, because the App is free general wellness education and not medical care, I am not responsible for decisions you make about sleep, medication, driving, work or health after using it; for losses that were not reasonably foreseeable; for business losses; or for losses caused by events outside my reasonable control. If you are a consumer, your statutory rights, including under the Consumer Rights Act 2015, are not affected.
13. Terms required by Apple
If you downloaded the App from Apple’s App Store, you and I agree that:
- Acknowledgement. These terms are between you and me only, not with Apple Inc. (“Apple”). I, not Apple, am solely responsible for the App and its content. These terms cannot give you rights greater than the Usage Rules in the Apple Media Services Terms and Conditions.
- Maintenance and support. I am solely responsible for providing maintenance and support for the App, as described on the Support page. Apple has no obligation to provide any maintenance or support services for the App.
- Warranty. I am solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are my responsibility.
- Product claims. I, not Apple, am responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation, including in connection with the App’s use of the HealthKit framework.
- Intellectual property. If a third party claims that the App or your possession and use of it infringes their intellectual property rights, I, not Apple, am solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that you are not located in a country subject to a UK, US or other government embargo or designated as a “terrorist supporting” country, and that you are not listed on any government list of prohibited or restricted parties.
- Developer name and address. Questions, complaints or claims about the App should be sent to Adam Richard Turner, United Kingdom, at hello@adamrichardturner.dev.
- Third-party terms. You must comply with any applicable third-party terms when using the App, such as your mobile data or wireless service agreement.
- Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
14. Ending the agreement
You may stop using the App and delete your account at any time. I may end this agreement or suspend your account if you seriously or repeatedly break these terms, or if I withdraw the App. When the agreement ends, your licence to use the App ends and you must delete it from your devices.
15. Changes to these terms
I may update these terms when the App or the law changes. The “last updated” date shows the current version. If a change materially affects you I will tell you in the App before it takes effect. If you do not agree to a change, stop using the App and delete your account.
16. Governing law and disputes
These terms are governed by the law of England and Wales. The courts of England and Wales have non-exclusive jurisdiction, so if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts, and if you live in the EU you may also benefit from mandatory consumer protections of your country of residence.
